School portraits, seniors, sports, events, and online ordering

1. Scope
These Terms apply to school portraits, senior and graduation portraits, sports, events, milestone portraits, school galleries, and related products provided by Art of Portraits. They apply to parents, legal guardians, eligible adult Students, purchasers, and authorized gallery users. The school’s agreement governs the institutional Program; these Terms govern Family ordering, products, galleries, and licenses.
2. Voluntary Purchases
Unless the school expressly states otherwise, participating in picture day does not require a purchase. Families choose whether to view an available gallery, purchase products, request eligible retakes, or participate in optional portrait opportunities.
3. Authority and Student Matching
A purchaser represents that they are the Student’s parent or legal guardian, an adult Student purchasing their own Images, or otherwise authorized. No person may access, order, download, copy, or distribute another Student’s Images without authority.
A school may provide limited information needed to associate Images with the correct Student, class, grade, team, yearbook record, gallery, order, or retake. This may include name, identifier, grade, classroom, school, team, graduation year, parent contact, yearbook association, and privacy restrictions.
4. Gallery Access and Security
· Protect passwords, access codes, invitations, and verification information
· Do not post credentials publicly or share them with unauthorized people
· Notify Art of Portraits promptly of suspected unauthorized access
· Download purchased files before access expires and maintain backups
Gallery access is temporary. Expiration may be stated in school communications, the gallery, or order page.
5. Orders, Prices, and Promotions
An order is accepted after payment authorization. Prices, packages, promotions, deadlines, taxes, shipping, and availability are displayed during ordering. Promotions apply only for the stated period, may be limited to specified products or schools, generally cannot be combined unless stated, and have no cash value. The purchaser is responsible for accurate billing, shipping, email, product, Image, personalization, and quantity selections.
6. Products and Digital Images
Products may include prints, downloads, packages, yearbook Images, composites, memory products, calendars, magnets, cards, albums, banners, sports products, and graduation products. Minor differences between screen previews and physical products may result from monitors, paper, inks, crops, finishes, and production methods.
Digital purchases include only the stated resolution and rights. Families must download files before links expire, maintain backups, and review crop and color settings when ordering elsewhere. Art of Portraits does not guarantee results from unaffiliated printing laboratories.
7. Copyright and Personal-Use License
Copyright remains with Art of Portraits or the applicable creator. Full payment grants a nonexclusive, nontransferable personal-use license for personal display, personal social media, personal websites and profiles, gifts, and personal printing from authorized downloads. The license does not permit resale, sublicensing, commercial advertising, merchandise, false authorship, stock-service submission, removal of rights information, harassment, deception, defamation, exploitation, or material edits or AI transformations that misrepresent the original work.
8. Yearbook Images
When yearbook services are included, Art of Portraits may deliver the selected or designated Image and related identifying information to the school or yearbook provider. The school is responsible for final name verification, grade and class placement, layout, publication, printing, and distribution, except for a verified error caused by Art of Portraits.
9. Retakes and Makeup Days
A retake or makeup opportunity, if offered, depends on school availability, photographer availability, Student attendance, Program policies, the reason for the retake, and ordering deadlines. A retake may replace the original set for ordering or yearbook use. No retake is guaranteed for a Student who is unavailable, declines participation, lacks required authorization, or misses the available date.
10. Cancellations, Refunds, and Satisfaction
Customized orders generally cannot be canceled after production starts. Correctly delivered digital downloads are generally nonrefundable after access except where required by law. Damaged, defective, or incorrect products should be reported within [7/14] days with reasonable documentation. Available remedies may include correction, reprint, replacement, retake, credit, or refund to the original payment method when practical.
Families should contact Art of Portraits about image association, gallery access, crop, product quality, damage, missing items, retouching, Student identification, privacy, or unauthorized access.
11. Student Privacy and Promotional Use
Student information is used to administer the school-authorized Program and related Family transactions. Art of Portraits does not knowingly sell protected student information, use it for targeted advertising, create unrelated Student profiles, use identifiable Student Images to train public AI models without express permission, or publish a minor’s Image for general promotion without an appropriate release.
Picture-day participation and portrait purchase do not automatically authorize promotional use. A parent or guardian may contact Art of Portraits regarding a media release. Detailed practices appear in the Privacy Policy.
12. Communications
Transactional messages may concern picture day, galleries, orders, shipping, retakes, customer support, privacy, safety, and service updates. Promotional communications require appropriate permission and an opt-out method where required. Covered Canadian messages will follow applicable anti-spam requirements.
13. Retention and School-Specific Rules
Images and supporting records may be retained as described in the Privacy Policy, but permanent storage and indefinite reorder availability are not guaranteed. School-specific rules regarding clothing, props, poses, uniforms, eligibility, retakes, senior submissions, campus safety, and privacy govern school administration, while these Terms govern Family transactions with Art of Portraits.
14. Limitation of Liability and Consumer Rights
To the maximum extent permitted by law, Art of Portraits is not liable for indirect, incidental, special, punitive, or consequential damages. Aggregate liability for an affected transaction will not exceed the amount paid for that transaction unless law requires otherwise. A reasonable remedy for lost, corrupted, misassociated, or unusable Images may include recovery, correction, retake, replacement, credit, or refund. Nothing limits mandatory consumer, warranty, refund, or privacy rights.
